How I can know if a business name or slogan may already registered?

I'm starting a website to be the basis for a health and fitness of the company. I have certifications as a personal trainer and nutritionist, and have worked as a public speaker and instructor. I thought a website would be a good place to combine these skills. I received the name of the website I wanted and assumed that I could not get the name if it were a trademark now. A friend of mine says I'm wrong. Before sinking a lot of cash in the promotion and other things, I would like to know that I will not be sued for a year or two on the road.

Get the domain simply means that the exact domain name is available, but that does NOT mean that there is a prior trademark or a problem with the first use of name sector. To register a trademark, contact your state Secretary of State or a brand of U.S. Patent and Trademark Federal Office of a mark. If you are only conducting business in a state, then a State trademark is most appropriate. If you do business in at least two states or between the U.S. and any other country, you can apply for a trademark Federal. Before investing your time, money and effort into a name, we strongly recommend that comprehensive research be conducted to ensure that the name you really want available. This involves the search and signed pending the Federal and State trademark files as well as the common law National U.S. Files. Then, if clear, you can decide whether to submit an application for a federal or state trademark. I listed some links where you can make a preliminary check name. However, keep in mind that this is just scratching the surface of what's out there. Only comprehensive research will tell you if the name is actually available. But, these links are free and a great place to start, so I try them first. There are other sites that offer free searching capabilities in conjunction with its services trade, so I'm not able to post the links because of Yahoo! Terms of Service. You'll also want to check domain names and yellow pages for So I just do a search for "domain name search" and "national Yellow" and the corresponding links will open. Hope help!
